3. Service Description

CXWizard provides a platform that:

• Enables WhatsApp chatbot automation via integration with Meta's Business API and OpenAI
• Allows you to manage conversations, view contacts, and monitor interactions
• Stores conversation history and contact information on your behalf

4. User Responsibilities and Restrictions

You agree NOT to:

• Use the Services to transmit unlawful, harmful, or sensitive personal data (e.g., health, financial, or confidential government info)
• Attempt to reverse-engineer, decompile, or disrupt the platform
• Use the Services in a way that violates Meta's or OpenAI's terms of use
• Resell or sublicense access to the platform without written permission

You are solely responsible for:

• Obtaining proper customer consent before processing or storing their data via WhatsApp
• Complying with applicable privacy and communication laws (e.g., GDPR, CCPA)

5. Data and Privacy

We collect and store the following:

• Information you provide (business info, WhatsApp integration details)
• Message content and metadata from conversations processed via the platform
• Contact information of your WhatsApp customers

Your use of CXWizard is subject to our Privacy Policy, which explains how we collect and use data.

You retain ownership of your customer data. By using the Services, you grant us a limited license to process this data for the purpose of delivering our Services.

6. Fees and Payment

CXWizard may offer paid plans. If applicable:

• Payment is billed monthly or annually, depending on your chosen plan
• Subscription fees are non-refundable except as required by law or as expressly stated
• You may cancel your subscription at any time via your account settings; cancellation will take effect at the end of the billing cycle

We reserve the right to change pricing with reasonable advance notice.

7. Availability and Modifications

We strive to maintain service uptime but do not guarantee uninterrupted access. We may:

10. Disclaimers and Limitation of Liability

CXWizard is provided "as is" and "as available." We do not guarantee that the Services will be error-free or meet your specific requirements.

To the maximum extent permitted by law:

• We are not liable for indirect, incidental, or consequential damages
• Our total liability shall not exceed the amount paid by you in the 12 months prior to the claim

11. Termination

We may suspend or terminate your access to CXWizard at any time for:

• Breach of these Terms
• Illegal activity or abuse of the platform
• Non-payment (for paid users)

You may terminate your account at any time through your dashboard.

Upon termination, your access will be revoked, and we may delete stored data in accordance with our data retention policy.

12. Governing Law and Dispute Resolution

These Terms shall be governed by and interpreted under the laws of the United States, without regard to its conflict of laws rules.

You agree to resolve any disputes through binding arbitration or small claims court, and waive any right to participate in class actions.
